Official Rules for the 2010 NV Energy Customer Paperless Billing Sweepstakes

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  THIS SWEEPSTAKES IS NOT OPEN TO THE GENERAL PUBLIC.  YOU MUST BE A LEGAL NEVADA RESIDENT AND HAVE AN ACTIVE RESIDENTIAL OR SMALL/MEDIUM COMMERICAL NEVADA ACCOUNT WITH NV ENERGY TO ENTER OR WIN.

Agreement to Official Rules.  Participation in the “2010 NV Energy Customer Paperless Billing Sweepstakes” (the “Sweepstakes”) constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsors (as defined below), which are final and binding in all aspects of this Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

Odds.  The odds of winning a prize will depend on the number of eligible entries received.  Limit of one (1) prize per Eligible Account (as defined below) for each of the September Drawing, the October Drawing and the December Drawing (all as defined below).

Eligibility.  The Sweepstakes is open only to eligible entrants who are, at the time of entry and through the applicable Cut-Off Date(s) (as defined below): (1) individuals that are legal residents of the State of Nevada eighteen (18) years of age or older, have an active residential or small/medium commercial Nevada gas and/or electric service account with the Applicable Sponsor (an “Eligible Account”), and have agreed to, and complied with, the Paperless Billing Program (as defined below); or (2) business entities that have full power and legal authority to do business in the State of Nevada, have an active small/medium commercial Nevada account with the Applicable Sponsor, and have agreed to, and complied with, the Paperless Billing Program.  Entries for eligible business entities must be submitted by an authorized representative of such business entity (owner, officer, or other authorized employee) who is eighteen (18) years of age or older at the time of entry.  The Sweepstakes is sponsored by Nevada Power Company d/b/a NV Energy (“NPC”) (with respect to the southern Nevada service territory), 6226 W. Sahara Ave., Las Vegas, NV 89146, and Sierra Pacific Power Company d/b/a NV Energy (“SPPC”) (with respect to the northern Nevada service territory), 6100 Neil Rd., Reno, NV 89511 (individually, the “Applicable Sponsor” and, collectively, the “Sponsors”).  All directors, officers and employees of Sponsors, and each of their parent companies, subsidiaries, affiliates, and advertising and promotion agencies, and each of their immediate family members (spouses, parents, children, and siblings and their respective spouses), and those living in the same household as each, are not eligible to participate in the Sweepstakes.  The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void outside the State of Nevada and where otherwise prohibited.

How to Enter.  The Sweepstakes begins at 8:00 AM Pacific Daylight Time (“PDT”) on July 9, 2010, and ends at 11:59 PM Pacific Standard Time (“PST”) on December 12, 2010 (the “Entry Period”).  The Sponsors’ computer system shall be the official timekeeper.  To enter the Sweepstakes, you must do the following during the Entry Period:

(1) visit www.nvenergy.com;

(2) follow the instructions to log into or register for “MyAccount” and select either “Northern NV” or “Southern NV,” as applicable; and

(3) (a) if you have not registered for the Paperless Billing Program prior to the Entry Period, then follow the instructions to either register for (i) only the Paperless Billing program, which is a free electronic billing program (subject to, and together with, such program’s terms and conditions (available here: www.nvenergy.com/terms/paperless/), the “Paperless Billing Program”), or (ii) both the Paperless Billing Program and the Online Automatic Bank Draft program, a free electronic automatic payment program (subject to, and together with, such program’s terms and conditions, the “Automatic Bank Draft Program”) or (b) if you have already registered for the Paperless Billing Program prior to the Entry Period, then follow the instructions to either (i) confirm your registration for only the Paperless Billing Program and participation in the Sweepstakes and, or (ii) confirm your registration for the Paperless Billing Program and participation in the Sweepstakes, and register for the Automatic Bank Draft Program.

There is no charge to register or log into MyAccount.  All entries for the Sweepstakes must be submitted online and those submitted after the Entry Period will not be accepted.  Incomplete entries are void.  In the event of a dispute regarding who is entitled to the prize, entries will be deemed submitted by the “customer of record” on the Eligible Account. “Customer of record” is defined as the individual(s) or business entity that the Applicable Sponsor’s records show opened the Eligible Account.  If there is more than one winning customer of record, any prizes won will be split evenly between such customers of record.  All entries become the property of the Applicable Sponsor and will not be acknowledged or returned.  The Sponsors are not responsible for any entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion, or incompatibility at Sponsors’ servers or elsewhere, which entries are void.  Use of any automated process to enter is prohibited and may result in disqualification at the sole discretion of the Applicable Sponsor.  All entries will be subject to verification and shall be null and void if they are found to have been obtained outside legitimate channels of distribution, or are illegal, forged, defaced, mutilated or tampered with in any way or not obtained in accordance with these Official Rules.

Number of Entries.  Each eligible entrant will receive the number of entries identified in the table below in either the three (3) Southern Nevada Drawings (as defined below) or the three (3) Northern Nevada Drawings (as defined below), for each Eligible Account that entrant registers or confirms registration, as applicable, for the Paperless Billing Program, or both the Paperless Billing Program and the Automatic Bank Draft Program, as corresponds to the time of the entrant’s entry into the Sweepstakes during the Entry Period:

*Entrants must register Eligible Accounts for the Paperless Billing Program in order to receive ANY entries for registering Eligible Accounts for the Automatic Bank Draft Program.  Any entries awarded for registering Eligible Accounts for the Paperless Billing Program will be based on the time such Eligible Account is registered or confirms registration for the Paperless Billing Program, as applicable.  Any entries awarded for registering Eligible Accounts for the Automatic Bank Draft Program will be based on the later of the following: (a) the time such Eligible Account is registered for the Automatic Draft Program or (b) the time such Eligible Account is registered or confirms registration for the Paperless Billing Program, as applicable.

Random Drawings.  Each Applicable Sponsor will hold a total of three (3) random drawings.  Each Applicable Sponsor will hold one (1) random drawing on or about September 15, 2010 (the “September Drawing”) from all eligible Sweepstakes entries received by such Applicable Sponsor prior to 11:59 PDT on September 12, 2010 (the “September Cut-Off Date”).  Each Applicable Sponsor will hold one (1) random drawing on or about October 15, 2010 (the “October Drawing”) from all eligible Sweepstakes entries received by such Applicable Sponsor prior to 11:59 PDT on October 12, 2010 (the “October Cut-Off Date”).  Each Applicable Sponsor will hold one (1) random drawing on or about December 15, 2010 (the “December Drawing”) from all eligible Sweepstakes entries received by such Applicable Sponsor prior to 11:59 PST on December 12, 2010 (the “December Cut-Off Date” and together with the September Cut-Off Date and the October Cut-Off Date, the “Cut-Off Dates”).  The three (3) random drawings held by NPC are referred to as the “Southern Nevada Drawings.”  The three (3) random drawings held by SPPC are referred to as the “Northern Nevada Drawings.”

Winner Verification.  Three (3) potential winners will be selected for each of the three (3) Southern Nevada Drawings and each of the three (3) Northern Nevada Drawings, for a total of eighteen (18) potential winners.  All potential winners are subject to verification by the Applicable Sponsor.  All potential winners will be notified by mail and will be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release (“affidavit/release”) within ten (10) business days of date of issuance, and all other documents required by that affidavit/release.  If entrant declines in writing to accept a prize, such documents are not returned by the customer(s) of record within the specified time period, prize or prize notification is returned as undeliverable, the Applicable Sponsor is unable to contact a potential winner within a reasonable time period, or a potential winner is not otherwise in compliance with these Official Rules (including having an active Eligible Account and being an active Paperless Billing Program participant), the prize will be forfeited and, at the Applicable Sponsor’s sole discretion and time permitting, it may select an alternate winner from all remaining eligible entries. There will be three (3) alternate drawings after which the prize will remain unawarded.  Prizes will be fulfilled approximately twenty (20) business days after the conclusion of the particular drawing.

Prizes.  Each of the three (3) winners of NPC’s September Drawing and each of the three (3) winners of SPPC’s September Drawing will receive one (1) $250 cash prize in the form of a check from the Applicable Sponsor.  Each of the three (3) winners of NPC’s October Drawing and each of the three (3) winners of SPPC’s October Drawing will receive one (1) $500 cash prize in the form of a check from the Applicable Sponsor.  Each of the three (3) winners of NPC’s December Drawing and each of the three (3) winners of SPPC’s December Drawing will receive one (1) $1,000 cash prize in the form of a check from the Applicable Sponsor.  Prizes will be awarded “as is” with no warranty, guarantee or representations, either express or implied by Sponsors.  All prize details are at the Applicable Sponsor’s sole discretion.  The winner is fully responsible for any and all applicable federal, state, and local taxes.  If the winner does not have a SSN or FEIN, as applicable, and therefore cannot provide one on the affidavit/release and submit a completed W-9, the Applicable Sponsor will withhold federal income tax according to the withholding requirements of the Internal Revenue Service (“IRS”) and submit that withheld amount to the IRS on the winner’s behalf; the winner will receive an award that is net of the federal income tax withheld.  Winners of prizes valued at $600 or more will be issued an IRS 1099 Form for the value of the prize.  All costs and expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to, lodging, transportation costs, meals, gratuities and other expenses incurred by accepting or using the prize are the sole responsibility of the applicable winner.  Prizes are non-transferable and non-assignable and will be provided only to the customer(s) of record, with no substitutions except at the Applicable Sponsor’s sole discretion.  There will be no substitutions for any prize except by the Applicable Sponsor who reserves the right to substitute a prize with one of comparable or greater value at their sole discretion.  Other restrictions may apply.

Conditions/Use Rights.  By accepting any prize, each entrant consents to the use of their names and all accompanying personally identifiable information entrant submits, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the specific prizes described herein) to entrant, his/her/its successors or assigns, or any other entity, except where prohibited by law.

Privacy.  By participating in the Sweepstakes, entrant authorizes the Applicable Sponsor to collect, use, process, transfer and store all data provided by entrant, including without limitation, personal data, to the United States, or any location(s) throughout the world that the Applicable Sponsor deems necessary, whether within entrant's country of residence or elsewhere, and with such party(ies) as the Applicable Sponsor deems appropriate, for purposes of administration of the Sweepstakes.  All information submitted to the Applicable Sponsor as part of this Sweepstakes will be treated in accordance with the Sponsors’ privacy statement. Sponsors will only use entrant’s personal information to: (a) provide information about the Sweepstakes; (b) contact and publicize potential winners; and/or (c) if an entrant selects to receive additional information from the Applicable Sponsor, to send additional information to that entrant during or after the Entry Period.  Entrants to the Sweepstakes may be given the option to receive commercial e-mails from the Applicable Sponsor; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s consent to receive such e-mails.  Entrants must fully complete and submit all non-optional data the Applicable Sponsor requests to be eligible.  Entrants have the right to withdraw and correct their personal data, but entrants are not allowed to re-submit their entries for additional entries in the Sweepstakes.  Directions on procedures for submitting corrections to personal data are provided in the privacy statement of the Applicable Sponsor.

Release and Limitations on Liability.  By participating in the Sweepstakes, entrants agree to release and hold harmless all directors, officers and employees of the Sponsors, and each of their respective parent companies, subsidiaries, affiliates, and advertising and promotion agencies (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to any person or property that may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or acceptance, receipt, use, or misuse of any prize; and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery.  Entrant further agrees to release the Released Parties and their designees and assigns from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses and damages of any kind arising out of or in connection with the Sweepstakes or acceptance, possession, or use of any prize (including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.  Sponsors are not responsible if any prize cannot be awarded due to or interruptions due to acts of God, labor disputes or strikes, acts of war, natural disasters, weather or acts of terrorism.

Miscellaneous.  The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the State of Nevada, without regard to choice of law principles.  Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Nevada or the appropriate Nevada State Court located either in Clark County, Nevada for any claim relating to NPC or the Southern Nevada Drawings, or in Washoe County, Nevada for any claim relating to SPPC or the Northern Nevada Drawings; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of the Applicable Sponsor that may cause the Sweepstakes to be disrupted or corrupted, the Sponsors may, in their sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes from among the non-suspect, eligible entries received up to the time of the impairment.  Each Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, to be acting in violation of these Official Rules or any applicable laws relating to the Sweepstakes, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion.  Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law.  The Applicable Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event an insufficient number of entries are received, Sponsors reserve the right to cancel the Sweepstakes and shall be under no obligation to award the prizes.

Winners List. For a list of winners in the Northern Nevada Drawings and/or the Southern Nevada Drawings, send a self-addressed, stamped envelope to: NV Energy, P.O. Box 98910, Las Vegas, NV 89151-0001, Attn: NV Energy Customer Paperless Billing Sweepstakes, after December 31, 2010, but before July 1, 2011.  With respect to customers of record who are individuals, the Applicable Sponsor will only provide the first name, first initial of last name and the city/state of those customers of record who win and are individuals, unless otherwise required by law.  For customers of record that are business entities, the Applicable Sponsor will only provide an abbreviated form of the business entity’s legal name and the city/state of those customers of record who win and are a business entity, unless otherwise required by law.

Sponsors. The Sponsors of this Sweepstakes are Nevada Power Company d/b/a NV Energy (in the southern Nevada service territory), 6226 W. Sahara Ave., Las Vegas, NV 89146, and Sierra Pacific Power Company d/b/a NV Energy (in the northern Nevada service territory), 6100 Neil Rd., Reno, NV 89511.  Entrants shall not use the trademarks of Sponsors or falsely associate themselves with Sponsors during or after the Entry Period.
